Trade union legislation





A trade union means an association of workers in a particular industry. Trade union is an association formed primarily for the purpose of regulating the relations between workmen and employers or between workmen & workmen or between employers & employers





TRADE UNIONS (AMENDMENT) ACT 1947

In 1946 govt. of  India,   after consulting state govts, representative of employers and the trade unions and the Indian labor conference ,introduced the Indian trade unions bill in the central legislature providing for compulsory recognition of registered trade unions.

TRADE UNIONS (AMENDMENT) ACT 1947 

provided for compulsory recognition of trade unions on certain prescribed conditions  and introduced penalties for certain unfair labor practices on both TU & employer.

TRADE UNION BILL 1950

Que. Of amending Indian trade union act 1926 was discussed in meeting of standing labor committee 1949, and trade unions bill was introduced in the parliament of 23 Feb. 1950 and defined law relating to registered and recognized trade unions and certain unfair labor practices.

INDUSTRIAL RELATION BILL 1978

On  recommendation of first national commission on labor 1969 central govt. in consultation with state govt. framed comprehensive industrial relation bill in 1978  but the bill could not be passed.

TRADE UNION BILL 1982

The bill was containing provisions relating to machineries for the resolution of inter and intra union disputes , the bill could not be passed.

TRADE UNION ACT 2001

The act incorporate with some provisions of the earlier bill which could not be passed and partly , a few recommendation of the first national commission on labor. The broad features of amending act 2001 are
Requirement of 10% or 100 of workmen employed in an establishment  or industry with a minimum of 7 workmen as a member if trade union.
Ø  Election of members of executive and office bearers at an interval of not more than 3 years.
Ø  Prescribing minimum subscription of rural unorganized and other workers.
Ø  Designation of appellate court.
Ø  Limiting the proportion of outsiders to 1/3 rd of the office bearers or 5 whichever is less. 

TRADE UNION ACT 1926

The act has define trade union as “any combination whether temporary or permanent formed primarily for the purpose of  regulating the relation between workmen or employers or between workmen and workmen or for imposing restrictive conditions on the conduct of any trade or business and includes any federations of two or more trade unions
Trade dispute ” any dispute between employers and workmen or between workmen and workmen or between employers and employers which is connected with the employment or non-employment or the terms of employment or the condition of labor of any person”
